1. General Information

Welcome to CatchMemo! These Terms and Conditions ("Terms") govern your use of our website and services. By accessing or using CatchMemo, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

CatchMemo is a photo-sharing platform designed to enhance event experiences by enabling seamless photo sharing with QR codes and real-time photo walls, creating a personalized event gallery for guests to easily upload and share memories.

3. User Eligibility

CatchMemo’s services are optimized for users in Europe, though they are accessible worldwide. Performance may vary by location. You must be at least 18 years old or have parental consent to use our services if you are younger than 18.

4. Service Description

CatchMemo provides customizable event pages that allow users to create themed galleries for events, with unique QR codes enabling easy uploads from guests without requiring an app. Key features include:

• Customizable event galleries to fit any theme
• Live Digital Photo Wall for real-time photo streaming at events
• User-friendly QR code integration for guests to upload photos instantly
• Multi-device support for seamless access across web and mobile devices

5. Packages and Subscriptions

CatchMemo offers three packages with a one-time fee:

• Free Plan: Basic features with limited storage.
• Pro Plan: Allows up to 500 images and videos.
• Premium Plan: Offers up to 10,000 images and videos.

6. User Responsibilities

You are responsible for ensuring that any content you or your guests upload is appropriate, lawful, and does not infringe on the rights of others. All uploaded content remains your property, and you are responsible for verifying compliance with applicable laws.

Prohibited content includes, but is not limited to:

• Illegal or infringing content, including copyrighted material without permission
• Explicit, harmful, or abusive content
• Content that violates third-party rights, such as trademarks

7. Account Security

Your password is encrypted and cannot be accessed by CatchMemo. You are responsible for safeguarding your account credentials and immediately reporting any suspected unauthorized access to hello@catchmemo.com. We recommend regularly updating your password and using a unique, strong password.

8. Payment and Refunds

Payments are processed securely through Stripe. If an event is canceled within 14 days of purchase and no uploads or downloads have occurred, you may request a refund by contacting customer support at hello@catchmemo.com.

9. Privacy and Data Protection

CatchMemo collects data necessary for service functionality and uses Google Analytics to analyze usage patterns. We do not sell or share your personal data with third parties. Images are securely stored in the cloud and encrypted by our provider. Please refer to our Privacy Policy for more details.

10. User Conduct

CatchMemo reserves the right to reject or limit access to any event or account that violates these Terms. Prohibited actions include, but are not limited to:

• Uploading prohibited or harmful content
• Attempting to disrupt, modify, or compromise the security of CatchMemo’s services
• Misusing QR codes or bypassing system limitations

CatchMemo may restrict, suspend, or terminate user accounts that engage in these behaviors.

11. Intellectual Property

All content uploaded by users, including images and videos (User Content), remains the property of the user. By uploading content to CatchMemo, users grant CatchMemo alimited, non-exclusive, royalty-free, worldwide licenseto use, display, and store the content for the purpose of operating, improving, and promoting the service. This license allows CatchMemo to:

• Display and store images and videos within the designated event galleries
• Enable sharing through QR codes and the Live Digital Photo Wall
• Use anonymized data for analysis to improve platform functionality

If the user organizes or participates in an event using the free tier of CatchMemo's services, or voluntarily joins a CatchMemo-sponsored campaign or promotional program, the user further grants CatchMemo the right to use selected portions of their uploaded content formarketing and promotional purposes, including on CatchMemo’s website, social media, and promotional materials. CatchMemo will make reasonable efforts to credit the event or organizer where appropriate.

This additional marketing license is:

• Non-exclusive, royalty-free, and worldwide
• Limited to promotional use of CatchMemo’s products and services
• Revocable upon written request by the user, unless the content has already been published

If an event is using CatchMemo for lead collection or operates under a promotional or business context, users understand and agree that the event organizer (administrator) may be granted a license to view, store, and use uploaded images within the scope of that event’s purpose. This may include internal sharing, archiving, or limited promotional use related to the event itself.

The event organizer is solely responsible for obtaining any additional permissions or model releases required for public-facing or commercial use of identifiable individuals in the content.CatchMemo does not review or monitor organizer use of content and disclaims liability for any misuse.

CatchMemo does not have the right to use uploaded content for commercial purposes unrelated to service provision or without the user's express written permission.

12. Data Backup and Liability

While we strive to protect your data, we cannot guarantee continuous backup. Users are encouraged to maintain personal copies of their media. CatchMemo is not liable for any loss of data, including accidental deletion or technical errors that could impact data availability.

13. Limitation of Liability

CatchMemo is not liable for indirect, incidental, or consequential damages, including loss of profits, data, or goodwill, arising from or related to the use of our services. This includes events outside our control, such as service interruptions, unauthorized access, or unforeseen technical issues.

14. Termination

CatchMemo reserves the right to terminate or suspend user accounts at any time if these Terms are violated. In cases of account termination, users will be notified at their registered email address.

15. Governing Law and Dispute Resolution

These Terms are governed by Swedish law. Any disputes arising from or related to these Terms will be resolved exclusively in the courts of Sweden.

16. Exploitation of Bugs and Circumvention

Exploiting bugs, circumventing platform restrictions, creating multiple accounts to bypass limitations, or otherwise misusing CatchMemo’s services will result in immediate account closure and deletion of any associated events. CatchMemo reserves the right to pursue further legal action as necessary.

17. Changes to Terms

CatchMemo reserves the right to modify these Terms at any time. By continuing to use the service after changes are made, users agree to and accept the updated Terms. We encourage users to periodically review these Terms to stay informed of any updates.

18. Content Moderation and Reporting

CatchMemo reserves the right to monitor and moderate uploaded content to ensure compliance with these Terms. We may remove or block any content that is deemed inappropriate or in violation of these Terms. Users can report any objectionable content by contacting us at hello@catchmemo.com.

19. Indemnification

Users agree to indemnify, defend, and hold harmless CatchMemo, its affiliates, and its employees from any claims, liabilities, damages, losses, or expenses arising from their use of the service, violation of these Terms, or infringement of any third-party rights.

20. Force Majeure

CatchMemo is not liable for delays or failures in performance resulting from events beyond our reasonable control, including acts of nature, internet outages, and other unforeseen events.

21. Children’s Privacy

CatchMemo is not intended for use by individuals under the age of 18 without parental consent. We do not knowingly collect personal information from children under this age. If we discover that such information has been provided, we will take steps to delete it promptly.
